WHEREAS, the Urban County Council passed an amendment to the zoning ordinance on November 12, 2014 to allow as a minor amendment, the reduction of surplus parking spaces depicted on the original development plan; and
WHEREAS, the title contained a clerical error identifying the party introducing the amendment incorrectly as the Planning Commission which should have been RBHV Lexington, LLC and RBHV Lexington Retail, LLC; and
WHEREAS, the clerical error should be corrected for consistency but does not change the substance of the amendment to the zoning ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the title of Ordinance No. 134-2014 be and hereby is amended to read as follows:
AN ORDINANCE AMENDING ARTICLE 21-7(a) OF THE ZONING ORDINANCE TO ALLOW AS A MINOR AMENDMENT, THE REDUCTION OF SURPLUS PARKING SPACES DEPICTED ON THE ORIGINAL DEVELOPMENT PLAN. (RBHV LEXINGTON, LLC AND RBHV LEXINGTON RETAIL, LLC).
Section 2 - That the remainder of Ordinance No. 134-2014 is unchanged.
Section 3 - That this Ordinance shall become effective on the date of its passage.
