WHEREAS, Resolution No. 552-2000 imposes a moratorium on the issuance of building permits for all parcels in the Blue Sky Rural Activity Center that were served or capable of being served by the Blue Sky Wastewater Treatment Plant, to remain in effect until all state-issued sewer sanctions are lifted; and
WHEREAS, Resolution No. 5-2004 modified Resolution No. 552-2000 to allow the issuance of building permits where the work associated with the permit does not contribute to increased wastewater flow to the Blue Sky Wastewater Treatment Plant, but otherwise continued the moratorium; and
WHEREAS, as of October 9, 2014, the Blue Sky Wastewater Treatment Plant has closed and wastewater discharge by the plant has been terminated; and
WHEREAS, on October 21, 2014, the Kentucky Department of Environmental Protection - Division of Water issued a letter to LFUCG lifting all state-issued sewer sanctions.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the moratorium imposed by Resolution No. 552-2000 and Resolution No. 5-2004, relating to sanitary sewer tap-on and building permit approvals for parcels located in the Blue Sky Rural Activity Center, be and hereby is terminated, all state-issued sewer sanctions having been lifted.
Section 2 - That this Resolution is effective on the date of its passage.
