BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute an Expansion Area Development Exaction Agreement with North Forty Properties, LLC pursuant to Article 23 of the Zoning Ordinance providing for payment of non-sewer exaction credits for the construction of a stormwater facility system improvement in Expansion Area 2B, a copy of which is attached hereto and incorporated herein by reference.  

                     Section 2 - That this Resolution shall become effective on the date of its passage.

                     PASSED URBAN COUNTY COUNCIL:
