Summary
Authorization to approve the Federal Equitable Sharing Agreement and Certification with the Department of Justice, The Department of the Treasury. This Agreement sets forth the requirements for participation in the federal equitable sharing program and the restrictions upon the use of federally forfeited cash, property, proceeds, and any interest, which are equitably shared with participating law enforcement agencies. This Agreement also requires the submission of any discrimination cases involving the Lexington Police Department, which has been submitted by the Department of Law. The Agreement is a prerequisite to receiving any equitably shared cash, property, or proceeds. There will be no Budgetary impact. (L1100-16) (Barnard/Bastin)

BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute the Federal Equitable Sharing Agreement with the Department of Justice, Department of the Treasury, for participation in the Equitable Sharing Program.
Section 2 - That this Resolution shall become effective on the date of its passage.
