Authorization to execute a Memorandum of Understanding for parcel acquisition from the owner of record of 1181 Providence Place Parkway Lexington, KY at a cost not to exceed $440,000.00. The Expansion Area 3 pump station will be constructed on the parcel as contained in the 201Facilities Plan (Resolution 231-99) and the EPA approved Sanitary Sewer Remedial Measures Plan. BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the certificate of consideration and all other documents necessary to accept a general warranty deed from Anderson Ramsey, LLC, for 2 acres of land located at 1181 Providence Place Parkway.

                     Section 2 - That an amount not to exceed the sum of $440,000.00 be and hereby is approved for payment to Anderson Ramsey, LLC, from account 4003-303408-3466-92811, pursuant to the terms of the Memorandum of Agreement.

                     Section 3 - That this Resolution shall become effective on the date of its passage.
